General Description of Requirement
The City and VPB are interested in selecting an entity, which is not, by the terms hereof,
barred from submitting a Proposal, and which does submit a Proposal (each such entity, a “Proponent”) with the capability and experience to efficiently and cost-effectively meet the
objectives and requirements described in the RFP. The City and VPB currently expect to select
such a Proponent and then enter into negotiations with that Proponent, which will conclude in
the execution of a contract between the Proponent, the City and the VPB (such a contract, an “Agreement”). However, the City and VPB may: (i) decline to select any Proponent; (ii)
decline to enter into any Agreement; (iii) select multiple Proponents for negotiation; or (iv)
enter into one or more agreements respecting the subject matter of the RFP with one or more
Proponents or other entities at any time. The City and VPB may also terminate the RFP at any
time.
The City and VPB currently intend that Proposals will be evaluated in relation to their overall value, which will be assessed in the sole and absolute discretion of the city and VPB. In assessing value, the City and VPB expect to consider the factors described in Section 8 below, among others.
